Wills – What to Look Out For
Certain formalities are required to make a will valid. When someone dies, others may seek to challenge the validity of a will, in particular if they stand to benefit if the will is set aside by the court.
In addition, the testator must have capacity to make a will. They must be of sound mind and not subject to other influences.
Whilst an executor can witness a will, a beneficiary under the will who does so will not receive their bequest.
