Mismanagement of Cauda Equina Syndrome Study finds 93% of Litigators Left with Avoidable Bladder, Bowel and Sexual Dysfunction
A 2011 report concluded that, of a group of 40 patients pursuing clinical negligence litigation claims because their cauda equina syndrome was not managed appropriately, 93% were left with long-term bladder, bowel and sexual dysfunction which could probably have been avoided, (Todd NV, Br J Neurosurg. 2011; 25(4):503-8 (ISSN: 1360-046X).
Chadwick Lawrence LLP’s team of specialist clinical and medical negligence solicitors are specialists in medical and clinical negligence claims, including cauda equina syndrome compensation claims.
Cauda equina syndrome compensation claims can arise due to doctors failing to advise patients to seek emergency treatment if they develop ‘red flag’ symptoms, such as bilateral symptoms, urinary problems, bowel symptoms and saddle anaesthesia. Failure to provide appropriate advice can result in a delay in patients attending hospital when these “red flag” symptoms develop and the diagnosis of cauda equina syndrome and surgery being delayed. Other cauda equina syndrome claims relate to delays and/or failure by doctors to recognise or identify “red flag” symptoms, also resulting in delays in surgery. Claims can also relate to delays in carrying out or failure to carry out surgery at all.
We have dealt with cases where medical negligence in the management of cauda equina syndrome has resulted in permanent severe disability or death. Injuries can include foot drop to one or both feet, numbness and loss of sensation to the legs and saddle area, very severe back pain, bladder and bowel problems including incontinence and chronic constipation, sexual dysfunction, paralysis and even death.
