Driving Without Due Care & Attention

Commonly known as careless driving, this means that the police believe that you were driving in a way that falls below the standard expected of a competent and careful driver. If you were involved in an accident as a result, and are unable to offer any explanation, the court may infer that you were driving below this standard.

Examples of careless driving include:

  • Overtaking on the inside lane;

  • Tuning a car radio and being distracted by it;
  • Aggressive driving;
  • Tiredness/being unwell.
