CLAIMANT AWARDED £3,286 FOR WHIPLASH TYPE INJURY
Miss G was a 36 year old lady who was employed in childcare.
She was involved in a road accident when her car was stationary on a slip road waiting to get onto a main A road. She was hit from behind shunting her car out into the A road into the path of an oncoming vehicle.
Miss G suffered whiplash, muscle spasms in her shoulder, headaches together with nightmares and flashbacks. The majority of her symptoms lasted 5 months however the shoulder spasms continued to be a problem for 13 months in total.
We submitted her claim through the Rapid Claims Portal system holding the defendant responsible because he had been driving too fast, had failed to brake or swerve to avoid the collision and hadn’t been aware of Miss G’s stationary car in front of him.
The other side’s insurers admitted liability in the portal and we obtained physiotherapy treatment for our client at the insurers’ expense which she found very helpful.
The insurers initially offered £1,000 in compensation which was rejected. Medical evidence was obtained and the insurers were persuaded by us to increase their offer. Miss G accepted £3,286.25 in an out of Court settlement.
During the negotiations Miss G commented “I am happy for you to negotiate the best settlement for me, I totally trust you”. Miss G was happy with her settlement and commented “Thank you for the speedy postage of the cheque and thanks again for all your help”.
