Changes in Equal Measures

The Government is again focusing on retaining and codifying existing employment rights deriving from EU legislation, and has published Regulations which amend the Equality Act 2010. We discuss the changes which are due to come into force in January 2024, and the widening of rights in some areas.

There have been lots of relevant employment law/HR updates this week.

NHS surgeon found to be discriminated against in relation to disability after being told ‘many doctors are on the spectrum’.

The Claimant had disagreements with a senior staff member over email and in 2018 was accused of routinely turning up late at a performance review. The Claimant emailed the reviewer and made an official complaint about her comments. The Claimant was accused of harassing the reviewer, to which he became emotional and told the director that he had autism. The director, Dr. Barker, responded stating ‘I would say that there are a lot of doctors who are on the spectrum’. The surgeon was awarded more than £4,000 in damages, £3,000 being for injury to feelings and £1,320 in interest. The Tribunal accepted that the comments could reasonably be taken and were taken in a way to minimise the nature of the claimant’s condition. They found that this may have been well-meant but was still less favourable treatment.
