There have been lots of relevant employment law/HR updates this week.

Severely fatigued solicitor unfairly sacked over absences

The Claimant was a full-time director at Duncan Lewis Solicitors. The Claimant suffered from extreme fatigue which caused a lack of energy, difficulty reading documents, problems concentrating and lack of sleep. His symptoms got progressively worse throughout the lockdown period in March 2020 which ultimately led to his dismissal in November that year due to repeated absences after failing to work for 70 days between April and October 2020. It was confirmed in the tribunal that the Claimant had asked for help due to his illness, however workplace adjustments and offers of support were not followed up. The Claimant admitted to not reporting his absences as he was too unwell and could not carry out basic tasks. It was concluded there were no reasonable grounds for the firm to believe the Claimant’s illness-related absence was misconduct, and Duncan Lewis made incorrect assumptions about his health. The firm was found to have failed to take into account the solicitor’s health reasons for his absence and did not consider or commission medical evidence to understand his condition.

We look forward to presenting on how employers can encourage equality and diversity within the workplace, highlighting the law that protects the employees and employer, and the types of discrimination that happens within a working environment. We will also be assessing the importance of positive culture within any workplace and present a case study with the opportunity for our guests to engage in a Q&A session. We aim for our guests to go away with an understanding on how to best manage and negate these issues in practice.
