It is finally here after months of planning; we can finally announce the launch of the MMD Podcast. Released as an accompaniment to the published MMD, we have released a weekly podcast where we will be discussing all the recent news and legal updates in the world of Employment and Regulatory law.

Elsewhere in the MMD, Daniel has prepared the second part of his weekly video on misconduct outside work. We have our usual updates from the Employment Tribunal and this week our guest contribution comes from our Corporate and Commercial Team.

There have been lots of relevant employment law/HR updates this week.

Worker berated by boss over menopause wins £37,000

The Claimant, Karen Faquaharson, was accused by her manager of “strolling in” when she arrived late for work. The manager had also told the Claimant to “just get on with it” when she mentioned her symptoms of menopause, and said he had a “pet hate” of absences and dismissed her condition as “aches and pains.” The manager was generally known for referring to employees who were off sick as “snowflakes”. Following these remarks, the Claimant went off sick with stress and eventually resigned. She successfully brought claims against her employer for unfair dismissal and harassment and was awarded £37,400 in compensation.

Teacher engaged in ‘sexual banter with female student’ and gave alcohol to sixth-formers

The Claimant was a housemistress at a renowned public school. On one occasion when escorting a girl to a medical appointment, she was said to have quipped that the pupil “wouldn’t mind being alone with the doctor,” along with other inappropriate comments about the pupil being sexually active. It was alleged that the Claimant had caused fear and distress amongst a group of 14-year-olds when she asked one of them to remove their top and angrily threw a mobile phone. She eventually faced 19 allegations of misconduct, which led to the Claimant’s resignation from the school. She later brought claims of discrimination, claiming that her behavior was the result of ADHD, anxiety and depression. The tribunal dismissed the claims, concluding that there was “ample evidence” that she was not suited to the role and her continuous display of poor judgement.
