There have been lots of relevant employment law/HR updates this week.

Calling someone bald is harassment

The Claimant worked for the Company without any disciplinary issues for 24 years before being dismissed. The dismissal followed two heated arguments between the Claimant and his factory supervisor over the maintenance of equipment. On both occasions, the supervisor had referred to the Claimant as a “bald c***.” The original tribunal ruled there was a connection between the word “bald” and the protected characteristic of sex. In this decision, the Judge stated that the Company was right to submit that both men and women may be bald, however that baldness was much more prevalent in men and found it to be inherently related to sex. The original tribunal upheld claims of harassment relating to sex, unfair dismissal and wrongful dismissal. The Company appealed this decision and argued that it was the intention of Parliament that sex-related harassment in the Equality Act was to protect against acts specific to being male or female. However, the EAT dismissed the appeal and held that insulting a man for being bald does amount to sex-related harassment.
