This video examines the legislative changes to medical certificates, which allow these to be provided by a wider range of health professionals from 1 July 2022. We look at the DWP accompanying guidance, which should result in more comprehensive notes being provided, and consider whether ‘back to work’ notes can be requested by employers.

2022 Seminar Programme

 

Our Spring/Summer seminar programme has come to an end. However, we are in the process of planning and scheduling our new seminar programme which will restart in August 2022.

Gender critical views wins discrimination claim

The EAT held that a complaint of direct discrimination and victimisation is well founded in respect of the Respondents’ decision not to offer her employment and their failure to renew her visiting fellowship.

Ms Forstater “holds the belief that biological sex is real, important, immutable and not to be conflated with gender identity”. She considers that statements such as “woman means adult human female”, or “trans women are male” are Case Number: 2200909/2019 3 statements of neutral fact and are not expressions of antipathy towards trans people or “transphobic”.

The EAT held that gender critical views are protected under the Equality Act 2010.

Worker status: Dentists

The case of Sejpal v Rodericks Dental Ltd held that a dental associate who was engaged by the employer provided personal service to the company.

When the Claimant left for maternity leave, the dental practice closed the surgery she worked and her contract was terminated but other employees were moved to other locations. The Tribunal had to consider whether the Claimant was an employee, and thereby provided a personal service. Initially the tribunal held that the Claimant was not a worker or an employee. However, the EAT applied the statutory test and determined that the Claimant was required to perform some work or services personally.

Response to the Commission on Race and Ethnic Disparities

The government’s Equality hub has set out the best practice for government departments when collecting, analysing and reporting on data relating to Ethnicity. The best practice that should be adopted are based on three pillars; value, trustworthiness and quality.

The report states that the government strategy to ensure equality and fairness is; ensure prejudice and discrimination have no place in society, promote equality of opportunity and actively foster a sense of inclusion.
