In the MMD this week, Daniel has completed the final of his redundancy video updates, this week looking at the consequences of refusing an offer of suitable alternative employment. The regulatory team have produced an article on careless and inconsiderate driving, whilst we have a guest contribution from our Corporate Team on the issue of buying and selling shares in a private limited company.

Finally, we are again pleased to focus our partnership with Mental Health First Aid who will be running various courses out of our Wakefield office. The details of the events are listed below together with more information about the courses.

In the final part of this video series, we discuss the consequences of an employee refusing an offer of suitable alternative employment, with a focus on a variety of subjective reasons that an employee may put forward to justify a refusal.

Careless and Inconsiderate Driving

Offensive behaviour from Weetabix manager was constructive dismissal.

The Claimant was the food company’s UK health, safety and environmental manager. He claimed that his manager had subjected him to “inappropriate, bullying and harassing behaviour” including occasions where the manager swore at him and called him an idiot. The Claimant had raised grievances about his manager however these were dismissed, and appeals were not upheld. The claimant therefore brought tribunal proceedings for constructive dismissal. At the tribunal, Weetabix stated that the manager’s personal management style involved him using words that “humiliate” employees in order to “get the best out of people.” The tribunal found that the manager’s behaviour was sufficiently serious enough to breach the terms of trust and confidence in the Claimant’s contract of employment.
