There have been lots of relevant employment law/HR updates this week.

Starling Bank treated asthmatic employee unfavourably

The Claimant was told by her manager that she was “not a Starling person” because she left the office at her contracted time and sometimes worked from home. The Claimant needed to work from home more than others as the air conditioning in the office impacted her asthma and had informed her manager of her ill-health on multiple occasions, however this was ignored. When the Claimant asked to speak to her manager about her condition in light of the Covid-19 guidance, she was invited to a meeting and dismissed for performance-related reasons. The tribunal was not convinced that the manager had intended to dismiss the Claimant on that day for performance-related reasons, and instead dismissed her as he realised that she could ask about reasonable adjustments. Although her claim for unfair dismissal was dismissed, the tribunal did find that she had been treated unfavourable because of something arising from her disability and she was subjected to a detriment. The remedy judgement published this week showed that the Bank were ordered to pay the Claimant £1.1 million in compensation.

Citibank analyst dismissed for lying about expenses

Before travelling, the Claimant told a colleague that he would be taking his partner on a business trip to Amsterdam in July 2022. When he submitted his expenses claim, the Company raised concerns that the receipts appeared to show meals for two people, including two sandwiches, two coffees and another drink. The Claimant told the Company that the meals were all for him and that they were all “well within the €100 daily allowance” and complained about having to justify his eating habits. The Claimant was suspended whilst investigations took place and during the investigation, admitted that his partner did join him on the trip and for the meals in question. This was a breach of the Company’s expense management policy and he was subsequently dismissed for gross misconduct. The Claimant brought tribunal proceedings for unfair dismissal, however the tribunal held that the dismissal had been a proportionate response and that the Company had acted in a procedurally fair manner.
