Third Party Harassment – Changes to the Equality Act

This video explores the potential widening of the Equality Act to include acts of harassment carried out by third parties to the business, and how employers can defend claims by showing that they have taken “all reasonable steps” to prevent such behaviour.

Manager awarded £70k by tribunal in ageism case.

The Claimant was employed as a channel account director by the Company. His salary was £60k however could also earn commission of up to £40k based on the number of sim cards he sold through resellers. During his employment, he was unable to sell enough sim cards to earn any commission which led to criticisms from his line manager, Mr Hesketh, who said the Claimant needed “handholding” and was “underwhelming” in performance terms. The Claimant had also recommended someone he knew to fill a job vacancy within the Company. After meeting this person, Hesketh commented that he looked “old.” After the Claimant had been off work with stress, he found himself being appraised for his performance, however submitted a grievance against Hesketh as he felt that there was no need for a performance review and felt as though Hesketh wanted to replace him with a younger person. When the grievance did not uphold any of the Claimants’ points, he resigned and alleged age discrimination. The tribunal upheld his claim and awarded the Claimant over £71,000 in compensation.
