This video explores the rules on claiming statutory sick pay, from the perspective of both notification requirements and evidencing incapacity. There are limited rights available for employers to challenge medical evidence and to withhold SSP, which are commented on here.

There have been lots of relevant employment law/HR updates this week.

Train driver unfairly dismissed for tarantula and snakeskin pranks

The Claimant was aware that creepy crawlies made his colleague squeamish. The Claimant on one occasion left an exoskeleton of a tarantula in this colleague’s pigeonhole which gave her a fright. When the Claimant made a joke about this and threatened to do the same with a snakeskin, his colleague threatened to report him. He did in fact subsequently place a snakeskin in the pigeonhole and was reported for bullying. He was later dismissed for gross misconduct which the tribunal has ruled as unfair. The judge stated that these were childish pranks and extremely unlikely to have serious impacts.
