Employment Bill to be brought forward when parliamentary time allows

Following the Queen’s speech in May 2021, employment lawyers were left confused when there was no mention of the Employment Bill. During parliamentary debate last week, Paul Scully MP confirmed that he amends to bring in the long-waited Employment Bill when time allows.

Health and Safety detriment protection extended to workers from 31 May 2021

The Employment Rights Act 1996 (Protection from Detriment in Health and Safety Cases) (Amendment) Order 2021 came into force on 31 May 2021. Under section 44(1)(d) and (e), the right not to be subjected to a detriment in certain health and safety cases will be extended to workers. A worker will not be regarded as having been subjected to a detriment in contravention of the new section 44(1A) if the date of the relevant act or failure to act, or the last of a series of similar relevant acts or failures to act, occurred before 31 May 2021.
